At the heart of a fair society lies trust, and for the Judiciary, that trust hinges on one crucial element: integrity. Deputy Chief Justice Philomena Mwilu made a compelling case for this during the Judiciary Management Team retreat at the Lake Naivasha Resort hotel. She emphasized that unwavering integrity is not just desirable; it's the very foundation upon which the public's faith in the justice system rests.
Mwilu's message was clear: integrity is indispensable for the long-term health and credibility of justice institutions. She highlighted that even the most innovative policies or substantial investments will fail without a bedrock of ethical conduct. This retreat, designed to assess the progress of the Social Transformation through Access to Justice (STAJ) blueprint, served as a crucial reminder of these core values.
"Integrity is the bedrock upon which public trust rests," Mwilu stated, setting the tone for the entire gathering. She boldly declared that moral leadership is paramount, and that doing the right thing, even when difficult, is the ultimate measure of leadership within the Judiciary. This wasn't just a lofty ideal; Mwilu framed integrity as a daily duty. Judicial officers and administrators are expected to be honest, principled in resource management, and committed to upholding the dignity of their offices.
But here's where it gets controversial: Mwilu reminded everyone that the Judiciary exists to deliver justice, not just efficiently, but fairly, addressing the justice needs of all Kenyans. Every administrative function, management process, and policy must align with this core mandate. This means that registrars, directors, managers, and staff all play a vital role in supporting judges and magistrates, ensuring their work is unhindered and efficient. Strengthening these systems, she argued, strengthens justice itself.
Reducing bureaucracy, streamlining communication, and ensuring proper resourcing were presented as practical steps toward extending the promise of justice to all citizens. Mwilu also stressed that efficiency and integrity are mutually reinforcing, and that all managerial choices should prioritize public service.
Turning to the STAJ blueprint, Mwilu emphasized its role as a guiding vision for administrative thinking and planning. She framed STAJ as a commitment to ensuring that every Kenyan, especially the marginalized and vulnerable, finds justice accessible, affordable, and fair. This included fostering humility, openness, and empathy in all interactions. The Judiciary's culture, she suggested, should be defined by these qualities.
Accountability, she added, should be embraced as a constructive mechanism for improvement, not as a punitive measure. Furthermore, Mwilu highlighted the Judiciary's increasing reliance on technology, including the ICT Masterplan, the Electronic Document Management System, and the proposed Situation Room. She saw these advancements, along with artificial intelligence, as vital for making justice faster, smarter, and more transparent. However, she cautioned against implementing technology for its own sake, stressing that strategies must be based on evidence and data.
And this is the part most people miss: The retreat, according to Mwilu, strengthened the management team's readiness to improve service delivery, ensuring that management systems are responsive, leadership is accountable, and the institutional culture is geared toward excellence.
